These terms govern the use of the mine, thanks. apps for iOS and Android and of the website minethanks.com. The provider is Bella Marketing EOOD, Bul. Bulgaria 128, et. 6, ap. 64, 4003 Plovdiv, Bulgaria (hereinafter “we”).
1. What mine, thanks. is
mine, thanks. is a service for creating, designing and sharing wish lists. You can create lists, add wishes via a product link or by hand, set the appearance of the shared list and pass the list on via a link. Recipients of the link can reserve wishes without having an account and without you finding out who made the reservation.
mine, thanks. is neither a retailer nor an intermediary. We sell nothing, ship nothing and are not party to any purchase. A purchase takes place exclusively between you or your guests and the respective shop; that shop alone is responsible for delivery, price, warranty and withdrawal.
A reservation in mine, thanks. is a note among guests, not an order and not a commitment towards anyone. It obliges no one to buy anything.
2. Conclusion of the contract
The contract of use is concluded when you sign in to the app with your mobile number and confirm the one-time code sent to you. There is no separate registration step; signing in and registering are the same process.
Using the shared list via a link — viewing and reserving — does not require the conclusion of a contract. Sections 4, 6 and 7 apply to it accordingly.
3. Free use
The use of mine, thanks. is free of charge. There is no trial period that turns into a subscription, there are no paid additional features and there is no payment data.
Should we offer paid features in the future, they will be expressly identified as such before use and confirmed separately. Existing features will not subsequently become subject to a charge.
You bear the costs charged by your mobile or internet provider for data transfer and for receiving the sign-in SMS yourself.
4. Minimum age
You must be at least 16 years old to create an account. If you are younger, you may only use mine, thanks. with the consent of your parents or legal guardians.
We do not collect any information on age and therefore cannot verify it. If we become aware that an account belongs to a younger person without this consent, we may block and delete it.
5. Your account
The account is tied to your mobile number and is personal. The one-time code from the SMS must not be passed on. If you lose access to your number, you lose access to the account; in that case, please contact us.
You are responsible for the content posted via your account and for whom you give a share link to. Anyone who has the link can see the list and make reservations — that is the purpose of the link and not a malfunction.
6. User obligations and prohibited content
You may not use mine, thanks. for unlawful purposes. In particular, it is prohibited:
- to post content that violates criminal law — for example insults, threats, incitement to hatred, depictions of sexual abuse, use of symbols of unconstitutional organisations
- to infringe the rights of third parties, in particular copyright, trademark, personality and data protection rights
- to post personal data of others without their consent, such as other people’s addresses, telephone numbers or photos
- to use mine, thanks. for advertising, chain letters, spam or affiliate schemes that do not serve the creation of a genuine wish list
- to distribute malware or to post links to it
- to circumvent security measures, to guess other people’s access data or share keys, to query in an automated manner or to extract content on a large scale
- to place a load on the service beyond the usual extent, in particular through automated mass requests
You can report unlawful content to us at support@minethanks.com. We review reports and remove or block content as soon as we become aware of its unlawfulness. There is no prior review of user-generated content.
If you breach these obligations materially or repeatedly, we may remove the content concerned, restrict use or block the account. We choose the mildest suitable measure and inform you, insofar as legally permissible.
7. Rights to your content
Your content remains yours. You merely grant us the simple, non-exclusive and territorially unlimited right to store it, process it technically and deliver it to the recipients of your share link — that is, exactly to the extent necessary for operating the service. This right ends when the content is deleted, unless backup copies with a customary retention period are affected.
We do not use your content for advertising and do not pass it on to third parties, except insofar as this is necessary to deliver the service. Details are set out in the privacy policy.
Product images and product names taken from a shop page when a wish is added originate from their respective rights holders. They are displayed exclusively to identify the desired item.
8. Availability without guarantee
We strive for reliable operation but do not owe any particular availability. Maintenance, disruptions at service providers we use and circumstances beyond our control can lead to outages.
We may further develop, change and discontinue features. If a feature that is essential to you is discontinued, you can end the contract at any time by deleting your account.
The automatic extraction of product data from shop pages does not succeed on every page. Whether it succeeds depends on which data the respective shop delivers and can change without prior notice. We do not owe any particular result; for every wish, the details can be entered by hand.
Prices and availability in a wish list reflect the status at the time the item was added. They are not continuously synchronised and may differ from the shop’s current offer.
We recommend not keeping content that is important to you exclusively in mine, thanks.
9. Liability
We are liable without limitation in cases of intent and gross negligence, injury to life, body or health, fraud, under the Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have assumed.
In cases of simple negligence, we are liable only for the breach of a material contractual obligation — that is, an obligation whose fulfilment makes the use of the service possible in the first place and on whose observance you were entitled to rely — and in this case limited to the damage that is typical for the contract and foreseeable.
Otherwise, liability for simple negligence is excluded. The rules on the liability of intermediary services for third-party content (Articles 4 to 8 of Regulation (EU) 2022/2065 on digital services) remain unaffected.
We are not liable for content posted by users or for the content of linked shop pages. Nor are we liable for a gift actually being bought, delivered or not bought twice: a reservation is a note, not a commitment.
If you post unlawful content and a third party takes action against us because of it, you indemnify us against justified claims insofar as you are responsible for the infringement. We will inform you before any acknowledgement or settlement.
10. Term, termination and account deletion
The contract runs for an indefinite period. You can end it at any time without giving reasons: in the app, you delete your account yourself, in the profile settings. This deletes the account, lists, wishes and reservations; the deletion takes effect immediately and cannot be undone.
You do not need to ask us for this. In addition — for example if you no longer have access to your device or your number — we will carry out the deletion on request at support@minethanks.com. This route is an addition, not the standard route.
We can terminate the contract with 30 days’ notice to the end of a month. In the event of material breaches of section 6, we may terminate extraordinarily and without notice.
When the account is deleted, your share links become invalid. Anyone who opens such a link will no longer see a list. Save beforehand what you want to keep.
11. Changes to these terms
We may change these terms if this is necessary because of a change in the legal situation, a decision by a court or an authority, a further development of the service or to close a regulatory gap — and insofar as the change does not unreasonably disadvantage you.
We will inform you of changes at least 30 days before they take effect, in the app or by message. If you do not object before they take effect, the new terms are deemed accepted; we will expressly point out this consequence in the notification. If you object, either party may end the contract as of the time the changes take effect.
12. Final provisions
If you are a consumer with your habitual residence in a state of the European Union, the mandatory consumer protection provisions of that state remain unaffected (Art. 6 of the Rome I Regulation).
For consumers, the statutory places of jurisdiction apply. For traders, the place of jurisdiction is the provider’s registered office, Plovdiv, Bulgaria.
Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provision.
